JUSTICE ARUN KUMAR ORAL ORDER 20-12-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Belsand P.S.Case No. 91 of 2017 registered under Sections 302, 323, 324 and 380 of the Indian penal Code. Allegation in brief is that petitioner in the night entered into the house of the informant and killed two ladies inmate of the house and while accused fleeing away chased by the informant, he also assaulted the informant and his father, but apprehended by the informant and family members.

Learned counsel for the petitioner submits that petitioner was called by the sister of the informant thereafter he has been falsely implicated in this case.

Learned counsel for the State submits that there is specific allegation against petitioner of killing two ladies after entering in

Patna High Court Cr.Misc. No.61147 of 2017 (2) dt.20-12-2017 2/2 the house in mid-night and was apprehended by the informant and other family members after chase and also caused injury to the informant and others.

Having considered the nature of offence, the prayer for bail of the petitioner is refused. The application stands dismissed. The trial court is directed to expedite the trial and conclude the same preferably within one and half years since the framing of charge. Let a copy of this order be sent to the Superintendent of Police, Sitamarhi to produce the prosecution witnesses after framing of charge in order to conclude the same within the stipulated period.
