ANJANA MISHRA ORAL ORDER 29-09-2015 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

Earlier the case diary was called for which has since been received.

The petitioners are apprehending their arrest in connection with Hasanpur P.S.Case No. 181/2014 registered under Sections 342, 323, 324, 326, 307 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the case against these petitioners is false as the allegation as made out in the FIR stands falsified by the injury report which is part of the case diary. It is further submitted by learned counsel for the

Patna High Court Cr.Misc. No.31891 of 2015 (3) dt.29-09-2015 petitioners that actually it was the informant side which had been indulging themselves in the commission of offence and had been repeatedly attacking the petitioners in their shop. Considering the aforementioned facts and circumstances and the material available in the case diary, let these petitioners, above named, in the event of their arrest or surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each in connection with Hasanpur P.S.Case No. 181/2014 to the satisfaction of Shri Dhiraj Kumar Bhashkar, Judicial Magistrate, 1st Class, Rosera, District Samastipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
