The petitioner wants to renew his prayer of bail, which was earlier rejected vide order dated 18.03.2017 passed in Cr. Misc. No. 4014 of 2017, on the ground that the petitioner is in custody since 08.10.2016, the trial has not been concluded within the time granted by this Court. The petitioner has got no intention to commit the murder, there was no intervening circumstance, there is land dispute between the parties and as such the petitioner deserves sympathetic consideration. Learned APP opposes the prayer of bail by submitting that the petitioner has repeated the blow.
In the facts and circumstances stated above, at present, finding no good ground for reconsideration of the prayer of bail
Patna High Court Cr.Misc. No.56071 of 2017(3) dt.13-12-2017 2/2 of the petitioner, again his such prayer stands rejected in Sessions Trial No. 296 of 2017 pending in the court of learned 7th Additional Sessions Judge, Muzaffarpur.
However, learned trial court is again directed to expedite the trial and conclude the same as early as possible, preferably within four months from the date of receipt/production of a copy of this order, failing which, the petitioner, if at no fault, may be at liberty to renew his prayer of bail.
