ANJANA MISHRA ORAL ORDER 09-09-2015 Heard learned counsel for the petitioner and the learned counsel for the Bihar State Food Corporation as well as the learned counsel for the State.
The petitioner is apprehending his arrest in connection with Upahara P.S. Case No.37 of 2015 for allegedly having committed the offence under Sections 406 and 409 of the Indian Penal Code.
It appears that for the same period of transaction, two F.I.Rs. have been registered, one in the year 2012, in pursuance thereof the petitioner had already approached this Hon'ble Court with a prayer for anticipatory bail, which was allowed in his favour. Subsequently, the BSFC has again lodged the present
Patna High Court Cr.Misc. No.31107 of 2015 (3) dt.09-09-2015 2/2 F.I.R. for the same transaction for the reasons best know to itself.
Considering the facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, in connection with Upahara P.S. Case No.37 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
