JUSTICE BIRENDRA KUMAR ORAL ORDER 03-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Ram Krishna Nagar P.S. Case No. 120 of 2017, a case under Section 302/34 of the Indian Penal Code.

Petitioner is husband of the victim. There is no eyewitness of the occurrence. Initially the F.I.R. was registered under Section 302 of the Indian Penal Code. However, charge sheet has been submitted under Section 306 of the Indian Penal Code. The petitioner is in custody since 15.06.2017. Considering the aforesaid fact especially the fact that the investigation is complete and on the basis of the material there is no reason to detain the petitioner further as under trial

Patna High Court Cr.Misc. No.54876 of 2017 (2) dt.03-01-2018 P2/ prisoner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
