JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-08-2019 This application has been filed for cancellation of anticipatory bail granted to opposite party Nos. 2 to 4, who are father-in-law, mother-in-law and Dewar, vide order dated 23.1.2019 passed by learned Additional District and Sessions Judge-II, Gaya in ABP No. 4456 of 2018 (449 of 2018) on the ground that on the basis of forged document that partition took place between them in which they got separate share but as a matter of fact partition suit has not been decided as yet. From the submission it appears that for the plea of taking forged document, on the basis of which bail has been
Patna High Court CR. MISC. No.20267 of 2019(2) dt.20-08-2019 2/2 granted to them, petitioner has to approach the court concerned for conducting inquiry to find out whether the document is forged or not. However, in stead of availing the same, petitioner has directed approached this Court for cancellation of bail granted to them.
In such view of the matter, I find no merit in this application. It is, accordingly, dismissed.
