Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-11-2021 Learned counsel for the petitioner, at the outset, seeks permission to rectify the pleadings made in paragraph '1' of the bail application.

Permission is accorded to make correction in course of the day.

Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Khajauli P.S. Case No. 43 of 2020 instituted for the offences under Sections 341, 323, 324, 325, 307, 379, 354(B), 448, 380, 427, 504, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 16.10.2020, is a person with clean antecedent and charge-sheet has been submitted in the case.

Patna High Court CR. MISC. No.31136 of 2021(2) dt.25-11-2021 2/2 Learned counsel for the petitioner submits that there is a case and counter case between the parties. Further, the allegation of assault is against the sons of this petitioner and this petitioner is alleged to be the order giver and the sons of this petitioner have been granted bail by order dated 06.01.2021 in Cr. Misc. No. 34265 of 2020.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 16.10.2020, charge-sheet has been submitted in the case, co-accused have been granted bail and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhubani in connection with Khajauli P.S. Case No. 43 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
