2. The petitioner apprehends his arrest in a case registered under Sections 303(2) and 317(2) of the Bharatiya Nyaya Sanhita.

3. Allegation against the petitioner is that he committed theft of Scooty of the informant.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case merely on the confessional statement of co-accused Sonal Kumar. Further submission is that no incriminating material has been recovered from the conscious possession of the petitioner. Except the confessional

Patna High Court CR. MISC. No.17742 of 2026(2) dt.25-03-2026 2/2 statement of co-accused Sonal Kumar, there is nothing material against the petitioner. Petitioner has got no criminal antecedent and he undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposed the prayer for bail.

Having considered the facts and circumstances of the case, nature of allegation and clean antecedent of the petitioner, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IX, Patna in connection with Shastri Nagar P.S. Case No. 510 of 2025, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.
