JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-04-2019 Petitioner seeks bail in anticipation of his arrest in connection with Naubatpur P.S. Case No. 272 of 2018, registered for the offences punishable under Sections 498A, 494 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
Allegation against the petitioner is of subjecting the informant to cruelty with respect to demand of dowry. Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and as a matter of fact he is still ready to keep her with dignity and care. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court CR. MISC. No.17200 of 2019(2) dt.01-04-2019 2/2 circumstances, this application is disposed of with a direction to the petitioner to surrender within a period of six weeks from the receipt of this order and file a petition beore the court below that he is still ready to keep the informant with him with dignity and care and on that learned court below will release the petitioner on provisional bail for a period of six months and issue notice to the informant in this case and after her appearance try to make reconciliation between the parties and considering the conduct of both the parties the court below will confirmed the bail bond of the petitioner, otherwise the court below may pass any other order(s) as it may deem fit and proper, including cancellation of his bail bonds.
