In this application, the petitioner apprehends his arrest for the offences punishable under Section 379 IPC, Section 135 and 138 of the Electricity Act.

During raid at the hospital of the petitioner, it was found that electricity energy was being consumed stealthy and by that way, a damage of Rs. 2,27,888/- to the Electricity Department was caused.

Learned counsel for the petitioner submits that the

Patna High Court Cr.Misc. No.19727 of 2015 (3) dt.02-07-2015 2/2 petitioner has been falsely implicated in this case but he is ready to deposit the alleged loss amount in 8 equal monthly installments and in that view of the matter, the learned counsel for South Bihar Power Distribution Company does not oppose the prayer of prearrest bail. In the facts and circumstances stated above, in case the petitioner deposits the loss amount of Rs. 2,27,888/- to the South Bihar Power Distribution Company in 8 equal monthly installments then after deposit of first monthly instalment, the petitioner shall be released on provisional bail on execution of bail bond of Rs 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Learned C.J.M., Sasaram in connection with Sasaram (Town) P.S. Case No. 1093/12 subject to the conditions as laid down in Section 438(2) of the Cr.P.C and after deposit of last instalment i.e. full loss amount, the provisional bail shall be confirmed by the Learned court below.
