This is an application for grant of regular bail filed on behalf of the petitioner. Petitioner is in custody in connection with Danapur Rail PS Case No. 16 of 2019 for the alleged offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation in the instant case is that near the toilet of Coach No. S-9 at Sadisopur Railway Station, total 22 liters of foreign liquor was recovered. Learned counsel representing the petitioner submits that nothing was recovered from the possession of the petitioner. He further submits that petitioner has no criminal antecedent and he is in custody since 21.02.2019.

Patna High Court CR. MISC. No.17826 of 2019(2) dt.26-03-2019 2/2 Considering the fact that petitioner has no criminal antecedent and he has remained in custody since 21.02.2019, this application is allowed.

Accordingly, let the petitioner above-named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Danapur Rail PS Case No. 16 of 2019.
