ANJANA MISHRA ORAL ORDER 02-07-2015 Heard learned counsel for the petitioners, learned counsel for the informant and the learned counsel for the State. The petitioners are apprehending their arrest in connection with Complaint Case No.2925-C/2013 for allegedly having committed the offences under Sections 406, 420/34 and 120B of the Indian Penal Code.
Learned counsel for the petitioners submits that the kingpin in the present case Vijay Swaraj had been in custody in connection with the present case. This Court while considering his application for bail has granted him provisional bail, vide order dated 22.05.2015 passed in Cr.Misc. No.15043 of 2015,
Patna High Court Cr.Misc. No.10674 of 2015 (3) dt.02-07-2015 2/2 and the matter has been referred to the Mediation Centre for further action.
Considering the fact that the main allegation is against said Vijay Swaraj and not against these petitioners and also the fact that Vijay Swaraj runs an NGO under the name and style of "Glove" whose proprietor is Vijay Swaraj, let both the petitioners, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Complaint Case No.2925-C/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
