The petitioner is apprehending his arrest in a case registered under Sections 420, 406 of the Indian Penal Code. The prosecution case, in brief, is that the petitioner took loan from the informant and the same was not returned to the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. There is no document to show that the petitioner had taken money

Patna High Court CR. MISC. No.21476 of 2019(2) dt.05-04-2019 2/2 from the complainant. The allegation made in the complaint petition is denied by the petitioner. The present case has been instituted for oblique reasons.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, (East) Muzaffarpur in connection with Complaint Case No. 72 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
