The petitioners seek bail in a case registered under Sections 323, 324, 325, 341, 307, 327, 379, 506/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution case in short is that the accused persons stopped the informant in the way on the point of pistol and broke his four teeth.

Patna High Court CR. MISC. No.17241 of 2019(3) dt.19-06-2019 2/2 It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 08-01-2019. Charge sheet has already been submitted. There is case and counter case between the parties. The injury on the side of the accused has not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana at Dhaka in connection with Chainpur P.S.
