JUSTICE ARUN KUMAR ORAL ORDER 19-12-2017 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Sugauli PS Case No. 188 of 2017 registered under Sections 341, 323, 353, 379, 427, 504 and 506/34 of the IPC.

The allegation is that the petitioner along with three others entered into the chambers of the informant and enquired from him why he sent reply to the letter of Block Education Officer without getting his approval, took away 4500 rupees cash from his pocket and another accused made an attempt to assault. Learned Counsel for the petitioner submits that the petitioner sought information from the District Public Grievance Redressal Cell Officer regarding illegal appointment of a teacher in the school prior to the alleged occurrence but no information was provided and this false case was instituted by the informant on that account. The petitioner has no criminal antecedent and has been in custody since 23.9.2017.

Having considered the said facts and circumstances, the petitioner, namely, Md. Sabir is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
