The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

Allegation is that the accused persons on the point of pistol looted golden and silver jewellery and house hold articles and cash of the informant.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.05.2018. There is no allegation of tampering of witnesses alleged against the petitioner. Charge sheet has been submitted in this case. The F.I.R. was instituted on 29.06.2017 against six unknown persons. After a period of approximately six months on the requisition made by the I.O., 16 persons including the petitioner

Patna High Court Cr.Misc. No.50360 of 2018(2) dt.13-09-2018 2/2 were made accused in the present case on 04.12.2017. There is recovery of certain domestic articles from the possession of the petitioner, which is alleged to be looted articles of the present case. The said materials were never put on Test Identification Parade. Other co-accused have been granted bail vide Annexure2 to the present application. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Hilsa, Nalanda in connection with Hilsa P.S. case No.423 of 2017.
