JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-08-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Marauna P.S.Case No. 32 of 2016, G.R. No. 765 of 2016, registered for offences punishable under Sections 366/34 of the Indian Penal Code.

As per F.I.R., allegation against the petitioners is of kidnapping the daughter of the informant.

Submission of the learned counsel for the petitioners is that the petitioners have been falsely implicated in this case and the F.I.R. has been lodged after delay of four days without giving any plausible reasons.

Patna High Court Cr.Misc. No.50650 of 2018 (2) dt.31-08-2018 2/2 APP from the impugned order it appears that the statement of the victim girl has been recorded under Section 164 Cr.P.C. where she has also stated that the accused persons took her away Delhi by train and assaulted.

n In view of allegation against the petitioners, above named, I am not inclined to grant bail to the petitioners. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioners that if the petitioners surrender before the Court below and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by this order of this Court.

With the aforesaid observation, this application is dismissed.
