01-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in S.K.Puri P.S. Case No. 96 of 2020, registered for the offence under Section 414 of the Indian Penal Code and Section 25(1-b)a of the Arms Act. As per the prosecution case, one stolen bike, one country-made pistol and two live cartridges have been recovered from the possession of the petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. The alleged motorcycle is not stolen one, rather it stands in the name of mother of petitioner and as such, Section 414 of the Indian Penal Code is not applicable. Petitioner is in custody since 17.03.2020. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.
