This revision application has been filed for setting aside the judgment dated 22.12.2014 passed by the 3rd Additional Sessions Judge, East Champaran, Motihari in Criminal Appeal No.105/22 of 2014/2014, by which he has affirmed the order dated 29.8.2014 passed by the Juvenile Justice Board, Motihari in Trial No.827 of 2014 arising out of Pakaridayal P.S. case No.88 of 2014, by which he has refused to release the Petitioner.
From the report of the Principal Magistrate, Juvenile Justice Board, East Champaran, Motihari, it appears that accusation has already been explained to the Petitioner on 2.4.2015 and summons
Patna High Court CR. REV. No.132 of 2015 dt.02-07-2015 2/2 have been issued to the witnesses.
In such circumstances, I am not inclined to revise the judgment dated 22.12.2014 passed by the 3rd Additional Sessions Judge, East Champaran, Motihari in Criminal Appeal No.105/22 of 2014/2014 as also the order dated 29.8.2014 passed by the Juvenile Justice Board, Motihari in Trial No.827 of 2014 arising out of Pakaridayal P.S. case No.88 of 2014.
The application is disposed of with a direction to the Juvenile Justice Board, East Champaran, Motihari to conclude the enquiry expeditiously without granting unnecessary adjournments to any party, for which reason he shall send a list of the witnesses fixing specific dates for each witness for their examination along with a copy of this order to the S.P., East Champaran, Motihari, who is directed to ensure the attendance of the witnesses on the date fixed by the Trial Court so that there is no further delay in the trial.
