JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-12-2017 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Special Case No. 08 of 2017 corresponding to Jogbani P.S. Case No. 34 of 2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code, Sections 30(g) and 38(i) of the Excise Act, Sections 63 and 64 of the Copy Right Act, Sections 27(b) (a) read with Section 36 AC of the Drugs and Cosmetic Act and Section 20 and 22 of the NDPS Act.

The allegation is regarding recovery of various quantities of drugs namely Spasmo Proxyvan Plus 8496 Cap., nitrosun-10-1000 tab., Parvo Cof-495 bottles, Corex cough Syrup350 bottles, Avil 320 Inj., Diazelab 100 Inj. and Lupigesuc 150

The learned counsel for the petitioner submits that the said drugs are not prohibited items neither they are narcotics. It is submitted by learned counsel for the petitioner that the recovered drugs are neither contraband nor spurious medicines. It is further submitted that co-accused persons have already been granted bail. The learned counsel further submits that the petitioner has a clean antecedent and he is in custody since 13.10.2017. Considering the nature of accusation, the period of custody already undergone and the fact that the petitioner has got a clean antecedent, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Araria in connection with Special Case No. 08 of 2017 corresponding to Jogbani P.S.
