JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-05-2019 The petitioner seeks regular bail in connection with Chautarwa P.S. Case No. 183 of 2018, registered for offences punishable under Sections 20, 22, 24 and 25 of the NDPS Act. Prosecution story is that the police while patrolling saw four persons coming on two motorcycle and on seeing the police they became nervous, thereafter, three persons were apprehended and on search total 70 K.g. of ganja has been recovered It has been submitted on behalf of the petitioner that save and except the confession of co-accused, there is absolutely nothing against the petitioner and nothing has been recovered from the possession of the petitioner and he has been in judicial custody since 20.08.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, West Champaran, Bettiah, District - West Champaran, in connection with Chautarwa P.S. Case No. 183 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
