In case such appeal is filed by the petitioner, within a period of one months along with a copy of this order, the Appellate Authority is required to decide the appeal on its own merit after condoning the delay in filing the appeal in view of the fact that the petitioner was pursuing his remedy in writ which remained pending since 2016.
