The petitioner seeks bail in connection with Mahnar P.S. Case No. 370 of 2019, registered under Sections 413, 414 and 34 of the Indian Penal Code.

The accusation is that in course of checking of the vehicle at Police Station Turning, Mahnar, three persons were seen on one Apache motorcycle. On giving signal, they started to flee away, but, on chase while one person, who was on rear seat, succeeded to flee away, but, two persons apprehended, who disclosed their names Golu Kumar and Aditya Thakur (petitioner). On demand the paper of the motorcycle, they did not produce any paper and on query they disclosed that they used to commit theft of motorcycle and selling the same. On

Patna High Court CR. MISC. No.16051 of 2020(2) dt.05-06-2020 2/2 query, it was also detected that both are also accused in Mahua P.S. Case No. 254 of 2019, registered under Sections 379 and 414/34 of the Indian Penal Code.

Submission is that the petitioner has no criminal antecedent, but, on apprehending by the police in the present case he has been remanded in Mahua P.S. Case No. 254 of 2019. In the present case, the petitioner is in custody since 15.11.2019 and on investigation, the police has already submitted the charge sheet.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Mahnar P.S. Case No. 370 of 2019 to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, subject to the condition that out of two bailors, one must either be parent or close relative of both the petitioner.
