2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 447, 341 , 323 , 325 , 307, 504, 506 and 34 of the Indian Penal Code . 3 . As per the prosecution case , on 22.01.2024 at about 10:30 Am due to land dispute , all the 17 named F.I.R., accused persons including these petitioners assaulted informant and her family members. It is further alleged that petitioner No. 1 along with other co-accused persons assaulted with butt of pistol and petitioner No. 2 assaulted her husband with lathi.
4. It is submitted on behalf of the petitioners that
Patna High Court CR. MISC. No.19698 of 2025(2) dt.17-04-2025 2/2 petitioner are agnates and close door neighbours of informant and there is admitted land dispute between them. Present case is counter blast of Shambhuganj P S Case No. 28 of 2024 in which petitioners also sustained injury . Allegation of assault is general and omnibus against these petitioners. Petitioners are ladies and claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Banka in connection with Shambhuganj P . S. Case No. 30 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
