Petitioner apprehends his arrest in connection with Bakhtiyarpur P.S.Case No. 51 of 2017 registered for the offences punishable under Sections 147, 379, 411 and 427 of the Indian Penal Code.
Allegation as per FIR is of harvesting paddy crops of the informant.
Submission of learned counsel for the petitioner is that he is not named in the FIR and later on he has been made accused in this case and further submission is that petitioner has criminal antecedents.
Heard learned APP and from perusal of the record it appears that petitioner is accused in four other similar type of
Patna High Court Cr.Misc. No.49438 of 2018 (2) dt.29-08-2018 2/2 cases also.
Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order and to be disposed of, if possible, on the same day.
