The petitioner, who is in custody since 25.11.2019 seeks bail in connection with Kankarbagh P.S. Case No. 867/2019 dated 01.09.2019 registered for the offences under Sections 379 and 356 of the Indian Penal Code. The petitioner is alleged to have snatched the gold chain from the informant, while she was on her way to the market.

It has been urged on behalf of the petitioner that he is not named in the First Information Report and has been made accused in this case only because of his criminal

Patna High Court CR. MISC. No.16627 of 2020(2) dt.02-06-2020 2/2 antecedents. It has also been submitted that no incriminating material has been recovered from the possession of the petitioner. The petitioner though made his confession before the police but such confession was obtained under coercion.

Considering the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on furnishing his bail bonds to the satisfaction of learned Judicial Magistrate -1st Class, Patna, in connection with Kankarbagh P.S.
