11-01-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

Petitioners, in the present case, are seeking regular bail in connection with Forest Case No. 58 of 2017 registered for the offence punishable under Sections 9, 27, 31 of the Forest Animal (Protection) Act, 1972. Learned counsel for the petitioners submits that the petitioners have no criminal antecedent, they are labourer and have been falsely implicated in this case on the basis of an alleged secret information saying that they had killed one Sus Scrofa (Jangli Suwar). It is alleged that some meat of Scrofa (Jangli Suwar) was recovered from the house of the petitioners who are father and son.

Patna High Court Cr.Misc. No.29 of 2018 (2) dt.11-01-2018 Learned counsel for the petitioners submits that the maximum punishment under the provisions of the Act under which they are being prosecuted is three years. Learned counsel for the State opposes the prayer for bail of the petitioners.

Considering the facts and circumstances of the case and materials on record, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Forest Case No. 58 of 2017, District - Kaimur at Bhabhua, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
