JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-03-2019 The petitioners seek bail in anticipation of their arrest in connection with Islampur P.S. Case No. 28 of 2019, dated 21.01.2019, instituted for the offences under Sections 366A and 34 of the Indian Penal Code. It has been alleged by the informant that his 13 years old daughter has been kidnapped by the petitioners and others. The victim girl is stated to have returned, who has voluntarily disclosed that she is a major and had run away with one Bablu Kumar, who is related to the
Patna High Court CR. MISC. No.17847 of 2019(2) dt.29-03-2019 2/2 petitioners.
Considering the aforesaid statement of the victim girl, whose age has been assesd to be 18 - 19 years and practically no role having been attributed to the petitioners except for a vague statement of the informant that they also colluded with aforesaid Bablu Kumar in kidnapping the victim girl, the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Hilsa, Nalanda, in connection with Islampur P.S. Case No. 28 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
