1. Heard learned counsel for the petitioners as well as learned APP for the State.

2. The learned counsel for the petitioners seek permission to withdraw the anticipatory bail application with respect to petitioner no.1, Ishan Raut @ Ishanandan Raut.

3. Permission is accorded.

4. Accordingly, the anticipatory bail application is dismissed as withdrawn as against petitioner no.1.

5. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under

Patna High Court CR. MISC. No.22526 of 2024(2) dt.24-04-2024 2/3 Sections 341, 323, 307, 379, 325, 504, 506 and 34 of the IPC.

6. It is next submitted that petitioner no.5 has antecedent of one case and petitioner no.2,3,4 and 6 are persons with clean antecedent. It is also submitted that petitioners have been falsely implicated in the instant case by the informant on account of dispute relating to land.

7. It is next submitted that petitioner no.2,3,4 assaulted the wife, mother and son of the informant by an iron rod causing injury on head, thereafter petitioner no.5 and 6 are alleged to have assaulted sons of the informant by 'danda' on leg. It is next submitted that the injuries suffered by the injured is simple in nature, which amply demonstrates that petitioner never had any intention of committing a serious occurrence.

8. The learned APP opposes the anticipatory bail application.

9. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Pupri, Sitamarhi in

Patna High Court CR. MISC. No.22526 of 2024(2) dt.24-04-2024 3/3 connection with Nanpur P.S. Case No.613 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C. 10.

The application stands allowed.
