JUSTICE SUDHIR SINGH ORAL ORDER 22-04-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 147, 149, 323, 504, 506, 307 of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner is that he fired from his pistol, which hit on the arm of informant's brother, due to which he sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.02.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is previous enmity between the parties. For the said reasons, the present

Patna High Court CR. MISC. No.17404 of 2019(3) dt.22-04-2019 2/2 case has been instituted. The nature of injury is said to be simple as per opinion of the doctor. It is further submitted that the petitioner may be released on bail after completion of six months in custody from 05.02.2019.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail, after completion of six months in custody from 05.02.2019, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rahui P.S. case No.330 of 2018.
