In this case, the petitioner has made complain that the order of this Court passed in C.W.J.C. No.9507 of 2008 dated 19.09.2011 has not been complied with.

Patna High Court MJC No.3577 of 2014 dt.23-05-2017 In the operative portion of the order direction was given to the concerned District Programme Officer to make an enquiry with regard to validity of appointment of petitioner as Panchayat Teacher and her continuance in the school and if the finding is recorded in favour of the petitioner then the salary, arrears as well as current would be paid to her within two months. In the show-cause, the State has made statement that her claim for salary is not sustainable in view of the fact that for contesting the Panchayat election she has tendered resignation from her post on 09.03.2006 and her resignation was accepted by the Block Development Officer. Whereafter, she filed her nomination paper before the Block Development Officer and accordingly symbol has been allotted, which was 'camera" and as such, from the date of resignation she is not entitled for any salary. In view of the statement made in the show-cause, the present proceeding cannot continue. Accordingly, this contempt proceeding is drooped.
