Allegation against the petitioner is of kidnapping of the minor daughter of the informant and earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 12.10.2018 passed in Cr. Misc. No.54772 of 2018 .. Submission of the learned counsel for the petitioner is that he is in custody since 21.3.2018 and another co-accused, Ganesh Kumar, whose name also transpires in the statement under recorded under Section 164 Cr.P.C has been granted bail by a Co-ordinate Bench of this Court, vide order dated 2.7.2018 passed in Cr. Misc. No.37225 of 2018. Heard learned A.P.P. , who has opposed the pryaer for bail stating that the case of the co-accused Ganesh Kumar is on different footing of the petitioner. .

No.20454 of 2019(2) dt.11-04-2019 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, if any substantive progress is made out during the trial, the petitioner is at liberty to move for bail before the learned trial court itself, who will consider the prayer of the petitioner on the basis of materials available at that time.
With the aforesaid direction, this application is dismissed.
