Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 384, 353, 341, 342/34 of the Indian Penal Code.

The prosecution case as per the written report of SubInspector is that while he was on duty he intercepted two trucks loaded with stone chips without any valid papers. In the meantime, owners of the truck along with 4-5 persons came and threatened him with dire consequence and escaped with one of the trucks. When the informant headed towards District Magistrate office to complain two persons threatened him not to seize local trucks.

No.31074 of 2015 (2) dt.04-08-2015 2/2 It is submitted by the petitioner that he is Cleaner of one of the trucks and there is no specific allegation against him and driver of truck namely, Sanjeev Kumar and Surendra Singh has been enlarged on anticipatory bail vide Cr. Misc. No. 12059 of 2015 on 30.04.2015 by this Hon'ble Court.

Considering the aforementioned facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura (Bharrahi) P.S. Case No. 670 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
