2. The petitioner is apprehending arrest in connection with Siswan P.S. Case No. 274 of 2020, lodged on 29.11.2020, under Sections 272 & 273 of the Indian Penal Code and Sections 30(a), 38(B) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
3. As per the prosecution, total recovery of 100 litres of illicit mahua from the orchard has been made, which is the subject matter of the present case.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel further submits that the nothing has been recovered from the possession of the petitioner rather the recovery has been made
Patna High Court CR. MISC. No.19402 of 2025(2) dt.16-04-2025 2/2 from an open place which is accessible to all. Counsel also submits that the criminal antecedents of the petitioner are clean.
5. Learned APP for the State opposes the prayer for bail.

In the present facts and circumstances, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of Special Excise Court No. II, Siwan, in connection in connection with Siswan P.S. Case No. 274 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
