Petitioner, already in custody, seeks bail in connection with Atri P.S. Case No.173 of 2017, registered under Section 366(A) of the Indian Penal Code.
Allegation in brief is that the petitioner and one his associate came on a motorcycle and kidnapped the informant while she was going with her aunt, when she raised alarm the accused persons leaving her escaped away.
Learned counsel for the petitioner submits that the informant in her statement under Section 164 Cr.P.C. has not named the petitioner and she further explains that her aunt who was accompanying her called two boys and aunt is not an accused, due to the property dispute with the aunt of the informant the
Patna High Court Cr.Misc. No.60926 of 2017 (2) dt.19-12-2017 2 /2 petitioner has falsely been implicated, petitioner has clean antecedent and he is in custody since 13.10.2017. Having considered the said facts and circumstances, let petitioner, Ram Anugrah Yadav @ Banda @ Ram Anugrah Prasad, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Gaya in connection with Atri P.S. Case No.173 of 2017.
