JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 307, 377, 498(A), 504, 506/34 of the Indian Penal Code and Section 3/ 4 of the Dowry Prohibition Act.

The prosecution case as per F.I.R is that informant got married with the petitioner and soon after the marriage, torture was inflicted for non-fulfillment of

It is alleged that on 30.12.2021, all the F.I.R named accused persons including the petitioner came at her parents' house and started assaulting her. It is specifically alleged against father-in-law of the informant namely Binod Rai @ Gope that he inflicted fasul, a sharp edge weapon on the head of the informant, causing head injuries.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the informant. There is general and omnibus allegation against the petitioner. The specific accusation is against father-in-law of the informant. The petitioner is languishing in custody since 14.10.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
