1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with S.T. no. 1012 of 2022, arising out of Khodawandpur (Chhourahi O.P.) P.S. Case no. 52 of 2022 registered under sections 307, 147, 148, 149, 341, 323, 379, 427, 354B, 504 and 506 of the Indian Penal Code.

3. As per the prosecution case, it is stated by the informant that the fifteen named accused persons came variously armed. They resorted to indiscriminate firing, but the informant was saved some how. It is further stated that Sukkan Yadav and Balmiki Yadav assaulted his nephew while Karo Yadav and Vijay Yadav assaulted his daughter-in-law. All the accused persons participated in the occurrence and also took away Rs. 7000/- in cash and other articles as mentioned in the FIR.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.19186 of 2023(2) dt.16-05-2023 2/2 petitioner has been falsely implicated in the case along with 14 others. The allegations are general and omnibus in nature. The petitioner is in custody since 15.9.2022 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the FIR being general and omnibus so far as the petitioner is concerned, the petitioner being in custody for 8 months since 15.9.2022, chargesheet having been submitted in the case and the petitioner not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with S.T. no. 1012 of 2022, arising out of Khodawandpur (Chhourahi O.P.) P.S. Case no. 52 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge XI, Begusarai.
