JUSTICE ARUN KUMAR ORAL ORDER 10-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Barhat P.S.Case No. 45 of 2017 registered under Sections 304B and 328/34 of the Indian penal Code.

Allegation in brief is that after marriage, the deceased's husband and mother-in-law started making demand of motorcycle and used to torture her and on the alleged date of occurrence, mother-in-law informed the deceased's father regarding taking poison by his daughter to whom he found dead. Learned counsel for the petitioner submits that petitioner is father-in-law and there is no allegation against him regarding making any demand of dowry and the police has submitted charge sheet under Section 306 of Indian Penal Code. He submits that in fact she committed suicide by taking poison as she was not happy

Patna High Court Cr.Misc. No.62383 of 2017 (2) dt.10-01-2018 2/2 with the marriage, she was graduate and her husband was less educated and petitioner is in custody since 22.08.2017. Having considered the aforesaid facts and circumstances, the petitioner, namely , Saudagar Sah @ Saudagar Sao @ Sedagar Sah, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Mr. N.K.Yadav, J.M., 1st Class, Jamui in connection with Barhat P.S.
