Petitioner apprehends her arrest in Shastri Nagar P.S. Case No. 737 of 2019 (G.R. No. 7578 of 2019) registered for the offence under Section 420 of the Indian Penal Code and Section 138 of N.I. Act.

As per the prosecution case, petitioner is the signatory of the cheques, which were returned unpaid due to insufficient fund.

It is submitted on behalf of petitioner that for the same offence, the informant has earlier lodged a case, vide Gandhi Maidan P.S. Case No. 09 of 2019 and again, for the same offence, he has filed the present case. It is further

Patna High Court CR. MISC. No.16076 of 2020(4) dt.01-12-2020 2/2 submitted that petitioner is innocent and she has been falsely implicated in this case due to the fact that her husband was earlier employee of the informant's company.

However, learned A.P.P. for the State has opposed the bail application and submitted that petitioner is signatory of the cheque, which has bounced due to insufficient fund. Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner and accordingly, same is rejected.
