The petitioner apprehends his arrest in connection with Barh P.S.Case No.42 of 2015 registered under Sections 147, 148, 149, 324, 307 of the Indian Penal Code and 27 of the Arms Act.
Learned counsel for the petitioner submits that the present case has been lodged out of a personal dispute as the petitioner had not supported the informant's candidate in election. Both the parties have clashed. Learned counsel further submits that a counter case has also been lodged by the petitioner side which is marked Annexure-2 to this application. The prosecution has also drawn the attention of the court to the order dated 7.5.2015 passed in Cr.Misc.No.13660 of 2015 by which some similarly situated accused persons have been extended the privilege of anticipatory bail.
Considering the afore-mentioned submissions, let the petitioner, namely, Rinku Singh, in the event of her
Patna High Court Cr.Misc. No.30834 of 2015 (2) dt.13-08-2015 2/2 arrest/surrender in the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh in connection with Barh P.S.Case No.42 of 2015, subject to condition laid down under Section 438(2) of the Cr.P.C.
