The petitioner seeks bail in connection with Kahalgaon (Shivnarayanpur) P.S. Case No. 244 of 2018 registered under Sections 413, 414 of the Indian Penal Code. One Scorpio vehicle is said to have been recovered while parked in front of the house of the petitioner and he was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. Petitioner has no concern with the seized vehicle. The aforesaid Scorpio was parked in front of the house of the petitioner without his

Patna High Court Cr.Misc. No.49610 of 2018(2) dt.20-09-2018 2/2 knowledge. Moreover, there is no compliant of theft of the aforesaid Scorpio by the petitioner. He has no criminal antecedent. He has been languishing in custody since 24.05.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Shivnarayanpur) P.S. Case No. 244 of 2018.
