In this case, the petitioner is seeking anticipatory bail in connection with Jainagar P.S. Case No. 539 of 2018, G.R. No. 1419 of 2018 registered for offence punishable under sections 272, 273, 414/34 of the Indian Penal Code and 30 (a) of the Bihar Prohibition and Excise Act.

The Police has recovered 910 litres and 200 ml. of illegal wine.

The learned counsel for the petitioner submits that the petitioner was not there but only on the statement of one Vikash Kumar, his name has transpired but on the statement of Vikash Kumar, recovery was made from another place. In such view of the matter, this Court is not inclined

Patna High Court CR. MISC. No.17418 of 2019(2) dt.27-03-2019 2/2 to grant bail to the petitioner. However, if the petitioner surrenders before the court below, the court below without being prejudiced by this order, will take decision in accordance with law.

Accordingly this application is disposed of.
