Petitioner seeks bail in connection with Laukaha P.S. Case No. 163/2017, G.R. No. 1190/2017 for offences punishable under Sections 25(1-B) A, 26/35 of the Arms Act. The prosecution case, as lodged by the police personnel, is that the petitioner had loaded his photograph on his facebook account in which he has pointed a country-made gun on his head. The informant conducted a raid of the house of the petitioner and from the sound box one country-made pistol was recovered. Accordingly, a seizure-list was prepared. Patna High Court Cr.Misc. No.54884 of 2017 (2) dt.28-11-2017 2/2 petitioner that he is innocent, bears no criminal history, is an engineering student and no overt act has been committed by him. He submits that the co-accused, from whom he had purchased the said country-made pistol, has been granted privilege of bail by a coordinate Bench of this Court in Cr. Misc. No. 50103 of 2017 on 17.10.2017 and petitioner is languishing in custody since 05.08.2017.

However, learned APP for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-III, Madhubani, in connection with Laukaha P.S. Case No. 163/17, G.R. No. 1190/2017. (Nilu Agrawal, J) Rajesh/- U T
