The petitioner has preferred this application for grant of regular bail in a case registered under section 379 of the Indian Penal Code.

As per the prosecution case, while travelling in the train, it is stated by the informant that his service pistol along with cartridges and Rs.4,000/ in cash were stolen. It is submitted by learned counsel for the petitioner that the F.I.R. was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of co-accused Aman Kumar Pandit. No incriminating article has been recovered from the petitioner's possession who is in custody since 20.12.2021 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner, his name transpiring in the confessional statement of a co-accused made before police together with the petitioner having remained in custody for more than a year since 20.12.2021, the Court directs the petitioner to be enlarged on bail in connection with Saharsa Rail P.S. Case no.25 of 2021 (G.R. no.157 of 2021) on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Railway Magistrate, Khagaria.
