JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner is accused in connection with Masaurhi P.S. Case No. 44 of 2020/Special Case No. 906 of 2020, registered under Sections 30(a) and 37(b) of the Bihar Excise Act. The accusation is that on receiving secret information about preparation of illicit liquor at the bank of Morhar River, the informant along with other police personnel reached there. On seeing the police party, they started to flee away, but on chased, they were apprehended, who disclosed their names as Shankar Yadav (petitioner), Uday Bind and Sanjay Kumar. On search at the bank of Morhar River, one plastic container containing 20 litres country made liquor, two
Patna High Court CR. MISC. No.19209 of 2020(2) dt.05-06-2020 2/2 gas cylinder and one Gas Chulla were recovered and liquor smell was also coming from their mouths.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent and is in custody since 25.01.2020.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Court, Patna, in connection with Masaurhi P.S. Case No. 44 of 2020/Special Case No. 906 of 2020. Out of two sureties, one surety must be the close relative of the petitioner.
