This is an application for bail in connection with Digha P.S. Case No. 282 of 2017, registered for the offences punishable under various sections of the Indian Penal Code, including Sections 307 and ancillary Sections of the IPC and 27 of the Arms Act.
Allegation against the petitioner is that several persons, including the petitioner assembled and damaged property of Housing Board.
Learned counsel for the petitioners submits that there is no specific allegation against them and they are in custody since 23.09.2017. He further submits that similarly situated co-accused persons have been granted bail by a coordinate Benches of this
Patna High Court Cr.Misc. No.57314 of 2017 (2) dt.13-12-2017 2/2 Court passed in Cr.Misc.Nos.51639 of 2017 and 52484 of 2017. The learned APP opposed the submission.
Having heard both sides and in view of facts and circumstances, as stated above, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of SDJM, Patna in connection with Digha P.S.Case No. 282 of 2017, subject to the conditions as follows :
(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned,
(2) Petitioner will co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled. (Sanjay Kumar, J) B.Kr./- U
