JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with Kasba P.S. Case No.171 of 2017, registered for offences alleged under Section 379 of the Indian Penal Code and later on Sections 420, 411, 414/34 were also added.

Learned counsel for the petitioner submits that the petitioner is not named in the First Information Report and he has been falsely implicated in the case only on confessional statement of co-accused who has stated that the motorcycle in question was sold to this petitioner. He further submits that the motorcycle has not been recovered from the possession of this petitioner which is subject matter in this case. Learned counsel submits that the petitioner has got no criminal antecedent.

Patna High Court Cr.Misc. No.46 of 2018 (2) dt.11-01-2018 Learned APP opposed the prayer for bail.

Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Purnia in connection with Kasba P.S. Case No.171 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
