The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioners who apprehend arrest in connection with Jadia P.S. Case No. 229 of 2025, lodged on
Patna High Court CR. MISC. No.21922 of 2026(2) dt.08-04-2026 2/3 12.11.2025, under Sections 191(2)/191(3)/190/ 126(2)/115(2) / 118(1)/117(2)/329(3)/303(2)/109/76/352/351(2)/351(3)/3(5) of B.N.S.
3. As per the prosecution, an FIR has been lodged against nine accused persons, including the present petitioners. The allegation against the accused persons is that they came to the informant's agricultural land along with four to five unknown persons, started abusing the informant, and assaulted him. Thereafter, the informant fled to his home. After some time, the accused persons reached the informant's house, variously armed, and again started abusing and assaulting him. When the informant's brother came to save him, the accused persons also assaulted both the informant and his brother with farsa, as a result of which both sustained head injuries.
4. Learned Counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that there is inordinate delay in filing the instant case without giving any reason. Counsel submits that both the parties are gotiya and next door neighbour and due to land disputes there were free fight from both the sides. Counsel submits that antecedent of the petitioners are clean and they are ready to fulfill all the conditions whatsoever shall be imposed

5. Learned APP for the State opposes the prayer for bail of the petitioners.
6. Considering the nature of allegation and injury, this Court is not inclined to grant bail to the petitioners. Hence, the anticipatory bail application of the petitioners is hereby rejected. However, in the event of surrender of the petitioners within four weeks from today, the prayer for regular bail shall be considered on the same day without being prejudiced by the order of this Court.
