This application is for grant of regular bail in connection with Belhar P.S.Case No.278 of 2017for the offences under Sections 406, 409, 420 of the Indian Penal Code. At the very outset, it has been pointed out by the learned A.P.P. that the processes under Section 83 Cr.P.C. has already been exhausted against the petitioner prior to filing of this application, as such this application for anticipatory bail is not maintainable.
Heard learned A.P.P. and the learned counsel for the B.S.F.C..
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant
Patna High Court CR. MISC. No.19288 of 2019(4) dt.19-06-2019 2/2 privilege of anticipatory bail to the petitioner, however, if the petitioner surrenders and make prayer for regular bail, the same shall be considered on its own merit without being prejudiced by the order of this Court, and if possible to be disposed of on the same day.
