JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-08-2015 Heard learned counsels for the petitioners and the State. Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 302/201/34 of the Indian Penal Code.

Accusation is of killing the niece of the informant after twenty years of marriage.

It is submitted on behalf of the petitioners that petitioners are nephew and niece of the father of the husband of the victim and informant has himself admitted that victim was residing with her father. The petitioners are living separately. Moreover, the accusation has been levelled on suspicion only. The petitioners claim to be separate from victim. There is no eye witness to the occurrence.

No.31309 of 2015 (2) dt.04-08-2015 2/2 Considering the aforesaid stand of the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhagalpur in connection with Pirpainty P.S. Case No. 04 of 2015( G.R. No. 21 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
